Terms of service

These terms apply when you use HEAT-HITS-LIVE, run by HEAT HITS LIVE railway variable set NEXT_PUBLIC_BUSINESS_ABN=26178572385 (“we”, “us”). By creating an account or placing a bid you agree to them, along with our Privacy Policy, Shipping Policy and Refund Policy.

1. Your account

  • You must be 18 or older, or bid with the permission and supervision of a parent or guardian who accepts these terms and is responsible for payment.
  • One account per person. Use your real name, a working email and phone number, and a deliverable shipping address.
  • Keep your password private. You're responsible for bids placed from your account.
  • Before you can bid you must verify your email, add a shipping address, accept these terms and the shipping acknowledgement, and save a payment card.

2. Bidding

  • Every bid is a binding commitment to buy the card at that price, plus shipping, if you win. Bids can't be withdrawn.
  • Each card is its own auction with its own currency, opening bid, minimum increment and end time.
  • Some cards have a hidden reserve price. If bidding doesn't reach it, the card isn't sold and nobody is charged. The auction page shows whether the reserve has been met.
  • Anti-sniping: a bid placed in the final 2 minutes extends that auction by 2 minutes, and this repeats for every late bid.
  • The time on our server decides when a bid was placed and when an auction ends. Countdown timers on your device are a guide only.
  • Bid history is public, shown with an anonymous bidder alias rather than your name.

3. Winning and payment

  • The highest valid bid when the auction ends wins, provided any reserve is met.
  • Wins from the same close are combined into one order. You authorise us to charge your saved card automatically for the winning bid(s) plus shipping, in the auction's currency. Payments are processed by Stripe; we never see or store your full card number.
  • If your bank asks for extra verification, or a charge fails, we'll email you a link to pay. Payment must be completed within the time shown in that email.
  • Prices in other currencies are estimates only. Your bank decides the final conversion and any fees.

4. Non-payment

If a win isn't paid in time we may cancel the order, offer the card to the next-highest bidder at their highest bid, and restrict or suspend your account.

5. Listings and authenticity

We describe and photograph every card honestly and to the best of our knowledge. Condition grades for raw cards are our opinion. Graded cards are described by the grading company's label. If a card isn't as described, the Refund Policy applies.

6. Fair play

  • No bidding on your own behalf to push up prices (shill bidding), no multiple accounts, and no automated bidding tools or interference with the site.
  • We may void bids, cancel auctions or suspend accounts where we reasonably suspect fraud, error or a breach of these terms. Cancelled auctions are never charged.
  • If a technical fault affects an auction, we may extend, re-run or cancel it.

7. Shipping and refunds

Shipping costs, packing and delivery are covered in the Shipping Policy. Sales are final except as set out in the Refund Policy. Refunds are issued only after we've reviewed and approved a claim.

8. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that can't be excluded. Otherwise, to the extent the law allows, our liability for any claim is limited to the amount you paid for the order concerned, and we aren't liable for indirect losses or for outages, delays or events outside our reasonable control.

9. Trademarks

Pokémon and related names are trademarks of their respective owners. HEAT-HITS-LIVE is an independent reseller and isn't affiliated with or endorsed by Nintendo, Creatures, Game Freak or The Pokémon Company.

10. Changes and governing law

We may update these terms. The version in force when you placed a bid applies to that auction. These terms are governed by the laws of South Australia, Australia.
